Over half of UK adults do not have a Will. If you die without having a valid Will in place, your property and assets will be divided according to the Laws of Intestacy. This can cause distress and possible disputes among your family, as intestacy laws can result in people who you would not choose benefitting from your estate. For example, if you have been separated from your spouse for many years but are not yet divorced, they could inherit most of your estate. In cases where you and your partner are not married, your partner has no right to your property and assets under intestacy law, even if you have been together for decades. This can result in them suffering real financial hardship at a time when they are also grieving. Having a Will ensures that your loved ones know you wishes and minimises any stress and worry they would otherwise feel.

Although you can draft your own Will or LPA, there are significant risks in doing so. The most common example when it comes to Wills is someone gets left out or does not feel they have received their fair share of your Estate and challenges the Will after you die. This is incredibly distressing for everyone involved and can tear families apart. When it comes to LPAs, although most Attorneys are honest and would not dream of acting outside the powers you give them under the document, fraud and abuse do occur.
