Dental Negligence

Many people are afraid of going to the dentist; therefore, being subject to dental negligence and suffering an injury can be incredibly distressing.

Our Dental Negligence Solicitors can help you bring a compensation claim so you can fund corrective treatment and not have to worry about paying your bills if you have to have time off work to recover.

Our entire team is dedicated to ensuring our clients get the compensation they deserve. Dental negligence can lead to pain and disfigurement and we understand how worried you may be about your future. We will help you claim compensation with compassion and sensitivity, ensuring you always feel in control and know exactly how your claim is progressing.

Our skills and expertise mean most cases are settled outside of court. If we can accept your case, we can offer you a No Win, No Fee agreement, meaning you will only pay legal fees if your claim is successful (more on this below).

We can advise and support you with the following dental negligence claims:

  • Delayed or misdiagnosis of oral cancer.
  • Permanent nerve injury.
  • Periodontal (gum) disease.
  • Cosmetic and restorative dentistry claims such as bridges, implants, or root canal treatment.

Frequently Asked Questions

Dental negligence occurs when a dental professional provides treatment that is below the accepted standard of care and this causes you to suffer an injury or your existing dental condition to worsen.

To claim compensation for dental negligence, you must prove, on the balance of probabilities that:

  • The dental professional owed you a duty of care,
  • They breached their duty,
  • The breach provided a causal link to the injury you suffered.

Our job is to prove the above and we achieve this by first carefully listening to your story and understanding what happened to you and the impact your injury or worsening condition has had on your life. We will then obtain witness statements from people who were present whilst your treatment was being done. In some cases, we may need to instruct an expert witness to provide an opinion as to whether the dental treatment you received fell below the accepted standard of care and your future prognosis.

In many cases, a dental negligence expert witness can provide an opinion from analysing images. However, in complex cases, they may need to examine you in person. We understand that after what you have been through, you may find this distressing. Rest assured, we will take things at your pace. We have built up excellent relationships with expert witnesses thanks to our track record of providing excellent client care and successfully securing compensation. You can trust that everyone we work with is compassionate and sensitive to the trauma dental negligence victims had often suffered and will do everything possible to make the examination a relaxed, gentle experience.

Your compensation award will depend on the extent of the dental negligence, the harm you suffered, and your prognosis and future needs.

Medical negligence compensation awards are split into two categories:

General Damages

This is to compensate you for the pain, suffering, and loss of life enjoyment caused by the dental negligence. It also compensates you for loss of future earnings if you are unable to continue working. As well as income, it can cover the loss of pension contributions, and any other workplace benefits you may have been entitled to.

Special Damages

This is awarded to compensate you for financial expenses and losses you have incurred, or will incur, directly due to medical negligence. Examples include parking charges at the hospital, private treatment costs, counselling fees, and travel expenses.

Solicitors and the Courts refer to the Judicial College Guidelines which set out the range of compensation to be paid under general damages.

Dental Injury Compensation Range
Significant chronic tooth pain and deterioration of teeth caused by a condition such as from an untreated abscess. Up to £33,430
The loss of or serious damage to several front teeth £7,650-£10,010
The loss of or serious damage to two front teeth £3,810-£6,690
The loss of or serious damage to one front tooth £1,930-£3,460
The loss of or damage to back teeth per tooth £960-£1,500

If we can help you bring a compensation claim, we can represent you under a No Win, No Fee Agreement. This means that you will not pay legal fees if your claim is unsuccessful. We can further minimise your risk by organising After The Event Insurance, which will pay any expenses related to your case, such as expert witness fees and the other side’s costs if you lose your claim.

If you win your case, the other side is likely to be ordered to pay most of your legal costs and our legal fees. We will take a success fee in recognition of taking on the risk of your claim, and the percentage will be agreed in advance.

You can be completely confident that there are no hidden costs. As an SRA-regulated law firm, we have a legal duty to be fully transparent with you regarding how much you will pay.

Let us advise and represent you on your dental negligence claim. You can trust that we will always be on your side, protecting your best interests, and working tirelessly to get you the compensation you need.
