If a healthcare provider such as a doctor or midwife provided negligent treatment before, during, and/or after labour, and this resulted in you and/or your baby suffering an injury, you may have a medical negligence claim. You will need to show that:

  1. The healthcare professional owed you a duty of care,
  2. They breached their duty, and
  3. Their breach resulted in you or your baby suffering an injury.

Birth injuries can affect both the mother and baby. Examples include:

Mother

  • Third or fourth degree vaginal tear.
  • Post-par tum-haemorrhage.
  • Rupture of the uterus.
  • Infection.
  • Uterine prolapse.
  • Post-traumatic stress disorder (PTSD) or other mental health injuries such as ongoing depression and anxiety.

Baby

If you have suffered a birth injury, you have three years from the date of your injury or the date you realised medical negligence caused your injury to make a compensation claim.

You can make a claim on behalf of your child any time up to their 18th birthday. Once your child turns 18, they have three years (until their 21st birthday) to make a compensation claim.
