Frequently Asked Questions

Medical negligence, also known as clinical negligence, happens when a healthcare professional provides treatment that falls below the accepted standard of care, resulting in you suffering an injury or your existing condition to worsen. Medical negligence also includes doctors or GPs not diagnosing or misdiagnosing you.

For medical negligence to be established, you must prove, on the balance of probabilities, that:

  1. The healthcare professional owed you a duty of care,
  2. They breached that duty, and
  3. This breach resulted in you suffering a personal injury and/or you condition to worsen.

Our role as Medical Negligence Solicitors is to gather evidence to prove the above. We do this by examining your medical notes, instructing expert witnesses when required, and taking detailed statements from you and any other witnesses.

Rehabilitation is a set of interventions that help an adult or child who has suffered an injury or illness be as independent as possible when it comes to everyday activities, and be able to work, enjoy recreational activities, and personal relationships as much as possible.

Depending on the illness or injury suffered, it can include treatment and services such as:

  • Speech and language therapy.
  • Physical exercise training to improve muscle strength, voluntary movements and balance.
  • Modifying your home environment to ensure your safety and aid independence.
  • Preparing you for a prosthetic and making, fitting and refitting the prosthesis (in the case of an amputation).
  • Psychological therapies and counselling to help with any mental health matters resulting from your illness or injury.

Rehabilitation is incredibly important when it comes to recovering from medical negligence. The Rehabilitation Code 2015 provides a framework for NHS Resolution or insurers (in the case of private hospitals or clinics) and Medical Negligence Solicitors to work together to establish liability early and organise interim payments so you can access rehabilitation as quickly as possible.

If we can take on your case, we can offer a No Win, No Fee agreement. This means you will not have to pay any money upfront for your legal fees. You will have to pay expenses related to your case. These are known as disbursements and include things such as court or expert report fees. Disbursements can be covered by an insurance product called After the Event Insurance. After the Event Insurance can also cover any Court Order to pay the other side’s costs if you lose your claim.

If you win your case, the other side is likely to be ordered to pay most of your legal costs and our legal fees. We will take a success fee in recognition of taking on the risk of your claim, and the percentage will be agreed in advance. The most important thing is you do not have to take on any risk because if you lose your claim, you will not pay any legal fees and the disbursements will be covered by insurance.

You can be completely confident that there are no hidden costs. As an SRA regulated law firm, we have a legal duty to be fully transparent with you regarding how much you will pay.

If it is clear the NHS Trust or private clinic is liable for your injury or worsening condition, they may make you an initial offer of compensation. Many clients have had this happen and then approached us to see if they should accept.
