Medical Negligence

“Medical negligence happens when the medical practitioner fails to provide the care which is expected in individual cases, resulting in unnecessary suffering, injury or death of the patient. It can be any tort or breach of contract of health care or professional services rendered by a health care provider to a patient”.

If you have ever been in a position where you, a family member or friend has been given an incorrect medical diagnosis, or received treatment that is inadequate or incorrect, then you will know just how distressing and disconcerting this can be.

At Nayyars Solicitors we pride ourselves on our team of Medical Negligence Solicitors. Our knowledge and expertise mean that we can provide immediate legal representation and support you fully. Our team are dedicated to providing the best legal advice, whilst supporting you at a time that can be extremely sensitive and emotionally draining.

One of our team of experts in medical negligence will take you through an initial consultation to establish the facts and understand the circumstances that led you to get in touch.  We will help guide you through the legalities, in terms that you can understand, and confirm if you do have a claim for medical negligence compensation, and the next steps.

Please call our office today on….0161 491 8520

The earlier you contact the team at Nayyars the sooner we can start the investigation into your claim. Whilst the timescale to make a claim is usually within 3 years of the event, it will help immensely if you contact us sooner rather than later. The details will still be fresh in your mind, and it may be that the NHS or private healthcare professional may admit responsibility during the early stages to avoid a long and protracted investigation. This will also enable us to obtain interim compensation payments to help with rehabilitation, any care support you may need, daily living costs or medical costs you may be facing as a consequence.

Exceptions to the timescale rule for claims:
Children – medical negligence claims involving a child can be made any time before your child turns 18. On your child’s 18th birthday the three-year rule comes into effect.
Mental Capacity – if a person lacks the capacity to make a claim themselves, there’s no time limit for making a claim.

Please call us to discuss your specific claim. During your free no obligation consultation we will be able to guide you on the expected time your particular claim may take. Many factors come into play, such as the severity of your injury, or if fault is acknowledged. Whilst we aim to settle your claim within 12 months, more complicated cases can take a few years to settle.

At Nayyars Solicitors we take on most medical negligence claims on a ‘no win no fee basis’. What this means is that you won’t pay anything upfront and will only pay if your claim is successful. Should you win your case, your opponent will be responsible to pay most of your legal fees; the rest of the fees will be taken from your final compensation award. All through the claim we will keep you fully updated of the status of the claim and provide you with an indication of how much compensation you’re likely to receive.

We have years of experience handling all types of medical negligence cases. We’ll gather expert advice on your claim and assess any care needs you may have, ensuring that the compensation you receive reflects the support and care you require, providing you with the very best quality of life for your future.

Our medical negligence solicitors understand what you’re going through and can help you access specialist rehabilitation and support services to assist with your recovery. We know that, beyond compensation, you’ll want to know why things went wrong and we’ll help you get the apology and answers you deserve.
