The Late Payment of Commercial Debts (Interest) Act 1998 (Late Payment Act 1998) allows suppliers to add at least 8% a year interest on overdue payments for goods or services, plus a fixed sum for the administrative costs of recovering the debt.

Under the Late Payment Act 1998, you are entitled to:

  • Statutory interest of at least 8% above the Bank of England base rate for any late payment.
  • Add a fixed sum in addition to the interest on the debt. The amount is fixed by reference to how much money is owed.

If there is no agreed payment date, you can add interest after a 30-day period.

If you have an outstanding debt you can send a Letter of Claim This informs the debtor that there is a debt that must be paid by a certain date, and if they fail to respond to the letter within the timeframe set out, you may file court proceedings.

In an overwhelming majority of cases the debtor to pay their outstanding invoice after receiving a Letter of Claim.

The Letter of Claim process is governed by the Pre-Action Protocol for Debt Claims. The Protocol sets out the required steps both parties must undertake before issuing court proceedings. Failure to comply with these steps can result in the Court applying sanctions, for example, ordering the non-complying party to pay a greater portion of the court costs.

If you do not receive payment following the Letter of Claim, you will need to decide whether you wish to proceed with filing proceedings in court. If you choose to do so, the debtor will be served with documents will have 14 days with which to respond.

You must bring court proceedings within six years of the date of the invoice unless the time limit has been reset by the debtor accepting that they owe you money.

If the outstanding debt is worth £10,000 or less, it will be assigned to the small claims track, which is quicker and cheaper than bringing a claim in the County Court. The downside of the small claims track is it is difficult to reclaim your legal costs.
