Dispute resolution involves advising and representing parties who have had a disagreement (normally in a business context) reach a resolution.

ADR (also known as Non-Court Dispute Resolution) provides an alternative to having to go to court, which can be expensive and stressful. The most common types of ADR methods are:

  • Negotiation –parties look to negotiate a resolution with the help of a Dispute Resolution Solicitor. It is normally the first method suggested and in many cases, disputes are resolved at this stage.
  • Mediation –a neutral third party (known as a Mediator) facilitates communication with the disputing parties to try and reach a win win solution. Mediation is cheaper and quicker than litigation and the proceedings and outcome are private between the parties.
  • Adjudication – commonly used in building disputes. It involves an independent Adjudicator listening to both sides of dispute and making a decision, normally within 28 days.
  • Arbitration –an independent Arbitrator makes a final and binding award to end the dispute. It is similar to litigation and is mainly used in international commercial disputes.

Each method of ADR has its own advantages and disadvantages. We will explain everything you need to know before you proceed with one or more methods of ADR. What is important to remember is the courts encourage parties to try and resolve disputes outside of the courtroom.
