Children-related disputes
  • Who a child should live with and when the non-resident parent can see them.

Unless you are exempt for reasons such as there is a history of domestic abuse in your relationship, you will need to attend a Mediation Information and Assessment Meeting (MIAM) before being given leave to apply to the Court to resolve a family law dispute.

At a MIAM a Mediator will explain what mediation is, how it works, and the type of disputes that can be resolved through mediation. During the MIAM the Mediator will carefully assess whether mediation is a suitable method for helping you and the other party resolve your dispute.

Family Court hearings are held in private. Court reporters and legal bloggers may attend; however, they are forbidden from reporting or writing on a case unless the presiding judge gives express permission.
